Residence Permit for Spouses of EU Citizens

Did you know that if you have European citizenship and your spouse does not, your partner still has the right to live and work with you in Austria? Spouses of EU citizens can enroll in educational establishments, get a job and receive a salary, without distinction. However, it is important to pay attention to the requirements and follow the protocol established by the Austrian authorities.

How to apply for a residence card for your spouse

To request your spouse's residence card, they must be married or have a recognized stable union with a European citizen. The application must be submitted within a maximum of four months after arriving in Austria, but we recommend that you start the process as soon as possible .

The card must be requested in person from the local immigration authority, which could be the Bezirkshauptmannschaft , Magistrat or MA35 , if you are in Vienna. In addition to the required documents, you will have to fill out a form, which can be requested from the authority, or which you can also find and fill out by clicking here. The process costs €56.

Required documents

  • Valid identity document or passport

  • Recent photo (size: 35x45 mm to 40x50 mm)

  • Anmeldebescheinigung and Meldezettel of the EU citizen with whom the relationship exists (in our article on Living and Working in Austria with European Citizenship we explain how these documents can be obtained)

  • Documentary proof of the existence of marriage or civil union

  • The 'Aufenthaltskarte' costs €70

Remember that if the documents were not issued in German, they must be translated and apostilled by sworn and licensed translators.

After five years of legal and uninterrupted residence, the card holder can request the issuance of a permanent residence card.
